Trademark Infringement disputes include pre-lawsuit negotiations and litigation that stem from one person or company’s improper use of another person or company’s name, trademark or service mark, regardless of whether such name or mark is registered with the Federal or State patent and trademark office. Trademark disputes often include claims of dilution or conversion, as well as false representations and unfair competition.
Trademark claims are generally governed by the Federal Trademark Act (15 U.S.C. § 1051, et seq.), the Florida Trademark Act (Florida Statutes § 495.001, et seq.), the Florida Deceptive and Unfair Trade Practices Act (Florida Statutes § 501.201, et seq.) and the common law of Florida.
One of the more noteworthy trademark cases that we litigated was between The Vinoy House Inn (a small bed & breakfast in St. Petersburg) and Renaissance Hotel Holdings, Inc. (also known as the Vinoy Hotel in St. Petersburg). Click to view news article...
